Andres Past attended the conference „Health Insurance Contract“

Andres Past gave a presentation to conference „Health Insurance Contract“ on September 29, 2011. The purpose of this conference was to get an overview of the choice criteria of the contracting parties to the Estonian Health Insurance Fund, as well as the legislative framework which enables and restricts it. The subject of this conference was a conflict between legislative framework and legitimate expectation in case of both older and recent partners. The conference was attended by members of the parliament of Estonia, the Minister of Social Affairs, high management of the Estonian Health Insurance Fund and its officials as well as heads of  medical institutions. Solutions which would render the sharing of the funds provided by health contracts more just were sought to be found. The report of A. Past concentrates on the need to alter the procedure of entering into a medical treatment funding agreement in a manner which would be legally more correct and more guided by the patient’s interests. Additionally Estonian Bar Association’s experience in sharing the means of state legal assistance was handled.

 

Estonia enables claiming punitive damages

On 31st December 2010 amendments to the Law Obligations Act (hereinafter LOA) came into force in Estonia, introducing the regulation allowing claiming punitive and preventive damages. Though the new regulation allows exemplary damages to be awarded only in the event of non-proprietary damages, it nevertheless constitutes a general paradigm shift, allowing for a much broader protection of personal rights.

Review of reorganisation proceedings in Estonia

Until the adoption of Reorganisation Act Estonian legislation did not provide efficient regulation for companies which were in temporary financial difficulties, but could be “rescued” via certain turn-around proceedings to overcome the economically difficult period. 


Estonian legislation regarding insolvency was concentrated solely on bankruptcy proceedings and liquidation. However, that should be the last resource to satisfy the creditors’ claims and before turning to bankruptcy and liquidation, other methods should be tried to satisfy the claims with funds gained from economic activities. To serve these purposes the Reorganisation Act was adopted and hastily entered into force on the verge of financial crisis on the 26th of December 2008.
